Section 44ADA: The Freelancer's Tax Guide for India (2026)

For professionals with gross receipts under ₹75 lakh — the simplest legal tax structure in India

What is Section 44ADA?

Section 44ADA is a presumptive taxation scheme under the Income Tax Act designed specifically for professionals — including freelancers. Instead of tracking every expense and maintaining detailed accounts, you declare 50% of your gross receipts as profit and pay tax on that.

It applies to professionals like software developers, designers, writers, consultants, engineers, architects, and more — as long as annual gross receipts do not exceed ₹75 lakh.

How 44ADA Tax is Calculated

Step 1: Add up all your freelance income for the year (gross receipts)
Step 2: 50% of that = your taxable income (no need to prove actual expenses)
Step 3: Apply income tax slabs to that 50% figure
Step 4: Add 4% Health and Education Cess

Tax Slabs (New Regime, FY 2025-26)

Presumptive IncomeTax Rate
Up to ₹3,00,0000% (Nil)
₹3,00,001 – ₹7,00,0005%
₹7,00,001 – ₹10,00,00010%
₹10,00,001 – ₹12,00,00015%
₹12,00,001 – ₹15,00,00020%
Above ₹15,00,00030%

Add 4% Health and Education Cess on the total tax payable.

Worked Example

Gross receipts: ₹12,00,000/year (₹1L/month freelance income)
Presumptive income (50%): ₹6,00,000
Tax on ₹6L (new regime): ₹0 on first ₹3L + ₹15,000 on ₹3L–₹6L (5%) = ₹15,000
Cess (4%): ₹600
Total tax: ₹15,600
Net take-home: ₹11,84,400 (out of ₹12L gross)

GST: When Do You Need to Register?

If your annual freelance receipts exceed ₹20 lakh, you must register for GST and charge 18% GST on your services. This applies regardless of whether your clients are Indian or international.

Exception: Export of services (billing international clients in foreign currency) is typically zero-rated under GST — you may not need to charge GST to foreign clients, but still need to register above ₹20L and file returns.

44ADA vs Regular Taxation — Which Is Better?

For most freelancers, 44ADA is significantly simpler and often results in lower effective tax because:

Use regular taxation only if your actual verifiable expenses exceed 50% of receipts — which is unusual for most digital freelancers.
